YOUR USE OF PHOTODISC CLIPPIX IMAGES ON THIS SPECIAL BRODERBUND DISC
End User License
ClipPix images are licensed with the user in mind. We aim to maximize your use of the images and to minimize confusion about how they may be used. We encourage you to use these ClipPix images in projects such as presentations, advertising, and projects for sale. These uses are detailed below.
PhotoDisc grants you the nonexclusive, nonassignable right to install and use the ClipPix images and any derivatives or copies thereof (collectively, the "Images") on this disc on one computer and with one user at a time. The Images may be copied, modified and incorporated in materials in accordance with the following provisions:
(1) Personal Use. You may use the Images on-screen and print them for personal or internal company use.
(2) Advertising and Promotion. The Images may be included in advertising or promotional materials, communications and presentations for you or your clients.
(3) Products for Sale.
- Copies of the Images, in digital or printed form, may be incorporated in up to 10,000 individual product copies made by you (your "Products") and may be distributed as part of your products.
-You may sublicense the rights to use the Images in digital form as part of your Products. You may not sublicense the right to copy the Images or to incorporate the Images into other materials or other products.
- You agree not to distribute or market copies of the Images separately in any manner. The Images may not be placed in any product which is similar to ClipPix or competitive with ClipPix.
- You will need to include the following language in the credits or on the product packaging: "PhotoDiscTM ClipPixTM Images (c)1995 PhotoDisc, Inc."
(4) Other. Licensing rights for television programming, cable programming, motion pictures, wide area networks, or other uses not mentioned above are available directly from PhotoDisc. Pornographic use of the Images is prohibited.
(5) All rights to the Images are owned by PhotoDisc and its licensors and are protected by United States copyright laws, international treaty provisions and other applicable laws. You may not use the PhotoDiscTM or ClipPixTM names except as a credit or copyright notice with the Images. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this agreement. PhotoDisc retains all rights not expressly granted by this agreement.
PhotoDiscTM and ClipPixTM (the "Trademarks") are trademarks of PhotoDisc, Inc.
ADDITIONAL RIGHTS AVAILABLE. If you are unsure of your rights under this agreement or wish to secure additional licensing, please contact PhotoDisc for information. We have licensing options available that are easy to understand and designed to meet your needs.
WARRANTIES. PhotoDisc warrants that it has the right to grant this license to you. PhotoDisc warrants this disc to be free from defects in material and workmanship for 90 days from delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the disc or refund of the purchase price, at PhotoDisc's option.
GENERAL. All rights to this disc and the Images are owned by PhotoDisc and its licensors and are protected by United States copyright laws, international treaty provisions and other applicable laws. You may not use the PhotoDiscTM name except as a credit or copyright notice with the Images. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this agreement. PhotoDisc retains all rights not expressly granted by this agreement. This disc is licensed only to you. The license granted under this agreement may not be transferred without the prior written consent of PhotoDisc and will terminate automatically without notice from PhotoDisc if you fail to comply with any provision of this agreement. Upon termination, you must stop using the disc and the Images and must return the disc and all copies of it to PhotoDisc immediately.
